May be disclosed so far as it relates to status of disposal of a case. Content of report exempt u/s 8(1)(h)

Information partly supplied that documents in fir no. 230/2006, p.s. connaught place were received in FSL, Delhi for examination on 19.6.2006 and examination and case is under process of furnishing report. The process consists examination through scientific instruments such as stereo microscope, video spectral comparator-iv, documenter and vsc-2000/hr system, etc. under different lighting conditions. The tentative date of finalization of FSL report in this case is 20.11.2006. However, further information as well as copy of FSL report cannot be provided since exemption under section 8(1) (h) of the RTI act 2005 as its disclosure is likely to impede the process of investigation.

, it is informed that the IPO sent by you for rs.10/- as fee under RTI act is payable to GNCT of Delhi which cannot be encashed by this laboratory. as per rule 3 of right to information (regulation of fees and cost) rules, 2005 “a request for obtaining information under subsection (1) of section 6 shall be accompanied by an application fee of rs.10/- by way of cash against proper receipt or by demand draft or bankers cheque or Indian postal order payable to the accounts officer of the public authority”. Therefore, the IPO no. 59e 021028 sent by you is returned with the request to send a fresh IPO/DD in the name of accounts officer or director, forensic science laboratory, Delhi.

Further as far as information sought by you is concerned it is informed that in this laboratory there is no post which can be classified as paramedical because this laboratory is not a medical institute.

1 & 2. in view of the duties and functions of the lab assistants, it is considered to be a technical post.
Duties & functions of lab assistants: they are required to assist senior officers/officials in technical work like case exhibit examination, to run sophisticated instruments, collection of literature of concerned case, visiting crime scene, keeping the equipments in lab. In good working condition and initiate action in this regard or any other duty/work assigned by senior officer.
Duties of lab. attendants: to upkeep the laboratory rooks, dusting the instruments, sealing and packing of crime exhibits, also maintain the store of crime exhibits, to clean and wash the glassware used in the analysis or any other work assigned by senior officers.
3.:duties of peons in FSL: taking files from officers/section (inward& outward; taking dak pad to officers; taking stationery from stores for section/officer; Xerox copies and other hobs in the interest of proper working of administration, etc.
4.:infor. about point (4) to (7) is not available with this lab. and will be supplied by the concerned department.
8.: as per RRS of lab attendants in FSL, Delhi they are not entitled for promotion as laboratory assistants as the post of laboratory assistant is of technical nature. However, lab. Attendants in FSL, Delhi are entitled for promotion as gr.iv (dass)/LDC in Delhi govt. departments through services deptt. Gnctd and lab assistants in schools of dte. of education, gnctd

Some FSL do accept cases from public for a fee. If it is so the public can submit his specimen with requisite fee for exam and report.

The FSL is correct in asking for FSL deposit no, FIR no of the PS to be able to give status of the report. Crime no and date are available in the FIR which has to be given free of cost to the complainant. Or he may obtain the same from police under RTI act.

1. FSL, gnctd examines crime cases received from investigating agencies, judiciary, govt. departments, public sector undertakings, etc. however, this laboratory does not accept cases directly from general public/private parties.
2. status/progress of any specific case can only be given if fir no., FSL no., date of submission of cases in FSL is provided and the same is referred for examination to this laboratory by SHO, PS Hari Nagar, New Delhi.
